Returns Policy Website Sales

BACKGROUND:

This policy applies to Goods that have been purchased from Our Site www.insulfix.co.uk (“Our Site”).  This Returns policy and all Contracts are in the English language only.

  1. Information About Us

  2. Business Customers and Individual Consumers
    • This Returns policy applies to Business Customers and Individual Consumers as defined in our Website Terms and Conditions of Sale https://insulfix.co.uk/terms-and-conditions/ and the same definitions as set out in the Terms and Conditions of Sale apply to this Returns Policy.
  3. Faulty, Damaged or Incorrect Goods
    • If any Goods you have purchased From us do not comply with our contractual obligations as set out in the Terms and Conditions of Sale (“Non- Compliance”), then subject to sub-Clauses 3.1.1 to 3.1.3 and your compliance with sub-Clauses 3.2.1 to 3.2.5, We shall at Our option, repair the affected Goods, replace them, or issue you with a full refund for the price of the affected Goods. The following conditions shall apply:
      • You must give Us written notice of the Non-Compliance within 30 days of Delivery using a Returns Form which can be accessed here https://www.insulfix.co.uk/contact/
      • You must return the Goods in question to Us at Our expense (see Clause 4 for more information); and
      • You must give Us a reasonable opportunity to examine the Goods in question.
    • We will not be liable for any Non-Compliance as set out at Clause 3.1 in respect of any Goods if any of the following apply:
      • You have made any further use of the affected Goods after giving Us written notice of the Non-Compliance under sub-Clause 3.1.1;
      • The Non-Compliance has arisen as a result of your failure to follow Our instructions on the correct usage, maintenance, installation or storage of the affected Goods failure to follow other instructions provided by Us to You in respect of the Goods or, where no instructions are provided, your failure to follow good trade practice with respect to the same;
      • The Non-Compliance has arisen as a direct result of any information (incorrect or otherwise) provided by you to Us;
      • You have made any unauthorised alterations or repairs to the affected Goods; or
      • The Non-Compliance is the result of normal wear and tear, deliberate damage, negligence, or abnormal or unsuitable working conditions.
    • The terms of this Clause 3 shall also apply to any Goods which are repaired or replaced by Us under sub-Clause 3.2.
    • To return Goods to Us for any reason under this Clause 3, please complete a Returns Form https://insulfix.co.uk/contact-us/.
    • Refunds (whether full or partial) under this Clause 3 will be issued within 14 days of the day on which We agree that you are entitled to the refund.
    • Refunds under this Clause 3 will be made using the same payment method that you used when ordering the Goods.
  4. Delivery charges and cost of returns
    • If an order is cancelled or returned because you have received Faulty, damaged or incorrect goods (Goods that are not as specified in the Order Confirmation) then subject to your compliance with Clause 3 and all relevant instructions provided by Us to You in connection with returns, We will reimburse the Delivery charges and We will pay for the cost of the Return.
    • In all other circumstances in which an order has been cancelled we will not reimburse the Delivery Charges to You and You are liable to pay the cost of the Return. We may deduct any shipping or other costs incurred by Us in connection with your Return from any refund owing from Us to You.
  5. Individual Consumers returning Goods – Additional Contractual Rights
    • If you are acting as an Individual Consumer you may cancel your purchase for any reason within 14 calendar days of delivery using a Returns Form https://insulfix.co.uk/contact-us/ This does not apply Business Customers.
    • In addition, if you are acting as an Individual Consumer you may cancel your purchase within 30 calendar days of delivery if the Goods are faulty. We will also offer repair, replacement or refund for any genuine faults reported by You to Us in writing within 6 months from the date of delivery provided you have given us a reasonable opportunity to inspect the alleged faults including returning the faulty Goods to Us for inspection if we request return of faulty Goods.
    • For orders cancelled in accordance with 5.1 or 5.2 above, We will refund you for your cancelled purchase subject to you returning the Goods in their original condition.
    • Unless items are faulty damaged or incorrect (not as specified in the Order Confirmation) You will pay for all costs associated with returning the Goods to Us in its original condition and you will not be reimbursed Delivery Charges. You must give Us a reasonable opportunity to examine the Goods in question.
    • Refunds (whether full or partial) under this Clause 5 will be issued within 14 days of the day on which We agree that you are entitled to the refund.
    • We may deduct any sums owing by You to Us in respect of the cost of returning items from any refund that we are required to process to You.
    • Refunds under this Clause 5 will be made using the same payment method that you used when ordering the Goods.
